Acting as lead counsel on behalf of domestic and international air carriers, on a multitude of issues, including litigation evolving from Warsaw and Montreal Convention matters; turbulence; overhead bins; jet-blasts; §1983 claims; escalator, elevator and jetway malfunctions; general premises liability and construction site accidents (including strict liability claims under New York Scaffold Law); commercial disputes with vendors and former business partners.
- Defending insureds, including FAA certificated repair stations and pilot schools; fixed-base operators; public authorities and airport operators; air show committees; aircraft owners; flight instructors, flight schools and pilots; overhaulers and mechanics in numerous general and business aviation matters involving wrongful death and survival actions; severe bodily injury claims; property damage; products liability.
- Representing property owners and lessees, contractors and vendors, and an assortment of other commercial and professional enterprises, entrepreneurs, and individuals in numerous commercial and general liability matters, including litigation arising from business disputes; contract and indemnification claims; misrepresentation, fraud and breach of fiduciary duty; unfair competition and intentional business torts; real property and co-op matters.
- Prosecuting substantial value subrogation claims involving product liability issues, economic loss doctrine, and corporate veil issues.
- Advising insurance companies and claims managers on coverage issues, including third-party tenders, the status of additional insureds, late notice, pollution exclusions, trigger of occurrence issues, as well as policy wordings, and defending or prosecuting their interests in declaratory judgment proceedings.
- Closely coordinating with insurance carrier’s general counsel and national counsel to defend multiple industry-wide class action lawsuits brought by infamous New York class action plaintiffs’ firm.
